By using our website or engaging Premium Growth for services, you confirm that:

5. Digital Advertising Services

Premium Growth may manage advertising campaigns on platforms such as:

Google
Other advertising platforms agreed with the client

Advertising platforms operate independently of Premium Growth and may change their policies, algorithms, approval processes, pricing, targeting options, or technical functionality.

Premium Growth does not control the decisions, systems, algorithms, policies, or availability of third-party advertising platforms.

6. Advertising Budget

Unless specifically stated otherwise, advertising/media spend is separate from Premium Growth’s service fees.

For example, a client may pay:

Premium Growth’s management/service fee; and
The advertising budget paid to the relevant advertising platform.

Advertising budgets are generally paid directly to the relevant advertising platform by the client unless otherwise agreed in writing.

Premium Growth does not guarantee that an advertising platform will spend a particular amount at a particular time or generate a particular number of leads, sales, clicks, impressions, or conversions.

7. Marketing Results

Digital marketing performance depends on numerous factors, including:

Advertising budget
Competition
Market conditions
Product or service quality
Pricing
Website performance
Landing pages
Audience
Creative quality
Offer
Customer response
Advertising platform policies
Search engine algorithms
Historical account data

Therefore, Premium Growth does not guarantee specific results, rankings, sales, revenue, leads, followers, impressions, clicks, or return on advertising spend (ROAS) unless expressly agreed in writing.

We aim to use reasonable professional efforts to plan, execute, monitor, and optimise campaigns based on the agreed strategy and available information.

8. SEO Services

SEO results and search engine rankings can change due to search engine algorithms, competition, website changes, technical factors, content quality, backlinks, user behaviour, and other factors outside our control.

Premium Growth does not guarantee:

A specific Google ranking
A specific position on Google
A specific amount of organic traffic
A specific number of leads
A specific revenue amount
A specific timeframe for achieving rankings

SEO work is performed using reasonable professional strategies based on the agreed scope of work.

9. Website Development and Design

For website development or design projects:

The client must provide required content, information, images, logos, and access in a timely manner.
Project timelines may change if required information or approvals are delayed.
Additional features or functionality outside the agreed scope may result in additional charges.
Third-party services, hosting, domains, plugins, themes, APIs, or software may involve separate fees.
The client is responsible for ensuring that business information and legal content supplied for the website is accurate.

Unless otherwise agreed, website maintenance, hosting, domain renewal, premium plugins, third-party subscriptions, and ongoing technical support are not automatically included in the development fee.

10. Content and Creative Services

Where Premium Growth creates marketing content, graphics, videos, advertisements, captions, or other creative materials, the deliverables will be based on the agreed scope.

The client may be required to review and approve content before publication or advertising.

Premium Growth is not responsible for delays caused by late approvals or changes requested after approval.

11. Revisions

Revision limits may apply depending on the selected package or service agreement.

Requests that significantly change an approved concept, strategy, design, campaign structure, website functionality, or previously approved work may be treated as additional work.

Additional charges may apply where the requested work falls outside the agreed scope.

12. Fees and Payments

Clients agree to pay the fees specified in the applicable quotation, proposal, invoice, package, or service agreement.

Unless otherwise agreed:

Payments must be made according to the agreed payment schedule.
Work may begin after the required payment or advance has been received.
Taxes, third-party charges, advertising spend, software subscriptions, and other external costs may be charged separately where applicable.
Delayed payments may result in suspension of services.

Premium Growth may pause campaigns, deliverables, access, or ongoing work where payments remain outstanding.

13. Refunds and Cancellation

Refund and cancellation terms may vary depending on the service and the applicable agreement.

Because certain digital marketing services involve time, planning, strategy, campaign setup, creative production, and resources committed in advance, fees for work already completed may not be refundable.

Where a client wishes to cancel an ongoing service, the client should provide notice according to the applicable service agreement.

Any unused amount, refundable amount, or outstanding payment will be determined according to the applicable agreement and the work already performed.

14. Third-Party Platforms and Services

Premium Growth may use or work with third-party platforms and tools, including advertising networks, social media platforms, analytics tools, hosting providers, email platforms, payment services, and other software.

Premium Growth is not responsible for:

Third-party platform outages
Account suspensions caused by platform policies
Algorithm changes
Policy changes
Service interruptions
Changes in pricing
Changes in platform functionality
Third-party technical failures

Clients are responsible for complying with the applicable terms and policies of third-party platforms used for their campaigns or business accounts.

15. Intellectual Property

Unless otherwise agreed in writing, Premium Growth retains ownership of its pre-existing:

Templates
Strategies
Frameworks
Processes
Internal systems
Methodologies
Tools
Know-how
Reusable resources

Upon receipt of full payment, the client will receive the agreed rights to use final deliverables created specifically for the client, subject to any third-party licensing restrictions.

Third-party assets such as stock images, fonts, music, software, plugins, templates, or other licensed materials remain subject to their respective licences.

16. Client Materials

The client grants Premium Growth permission to use materials supplied by the client, such as logos, photographs, videos, product information, trademarks, and other business materials, solely for the purpose of providing the agreed services.

The client represents that it has the necessary rights or permissions to provide such materials to Premium Growth.

17. Portfolio and Marketing Use

Unless otherwise agreed in writing, Premium Growth may display completed work, business names, publicly available campaign creatives, website designs, or other completed deliverables in its portfolio, website, presentations, or marketing materials.

If a client requires confidentiality or does not want its project used for portfolio purposes, this should be communicated to Premium Growth in writing.

18. Prohibited Activities

Clients must not use Premium Growth’s services for unlawful, fraudulent, deceptive, abusive, or prohibited activities.

We may refuse or suspend services where we reasonably believe that a campaign, website, product, advertisement, or business activity violates applicable law or third-party platform policies.

19. Confidentiality

Premium Growth will take reasonable steps to protect confidential business information shared by clients in connection with the services.

Confidential information may include business strategies, account credentials, campaign information, pricing information, customer information, and other information identified as confidential.

Confidentiality obligations do not generally apply to information that:

Is publicly available
Was already lawfully known
Becomes publicly available without a breach of these terms
Must be disclosed by law or a competent authority

20. Account Access and Security

Where clients provide Premium Growth with access to advertising accounts, social media accounts, websites, analytics platforms, or other systems, clients remain responsible for maintaining ownership of their accounts.

Clients should not share passwords unnecessarily and should use appropriate security measures, including two-factor authentication where available.

Premium Growth will use account access only for authorised work.

21. Limitation of Liability

To the extent permitted by applicable law, Premium Growth will not be responsible for indirect, incidental, special, consequential, or unforeseeable losses arising from the use of our website or services.

This may include losses resulting from:

Loss of profits
Loss of business opportunities
Advertising platform changes

Account suspension
